MCP / Developer Terms

In short: These terms apply to developers who use the e-tailize MCP to build on top of selected integrations. They are separate from seller platform terms because MCP use has different technical and commercial risks.
Placeholders to confirm
1. MCP product
The MCP gives approved developers access to selected e-tailize integration capabilities through a model context protocol interface.
The MCP does not transfer ownership of e-tailize integrations, marketplace relationships, platform code or underlying infrastructure.
2. Access and accounts
- Access is for business and developer use only.
- Developers must keep keys, tokens and credentials secure.
- e-tailize may approve, limit, suspend or revoke MCP access for security, compliance, capacity or misuse reasons.
3. Rate limits and fair use
Rate limits, fair use rules and capacity commitments are stated in the developer documentation or the order form; e-tailize may adjust them with reasonable notice to protect platform stability.
Developers must not use automated traffic patterns that degrade the Services or connected marketplaces.
4. Resale and standalone integrations
Developers may build products that use the MCP as part of a broader application, subject to the applicable order form.
Developers may not resell e-tailize integrations or MCP access as a standalone integration product without written permission.
5. Intellectual property
- Developers own their application code.
- e-tailize owns the MCP, integrations, documentation, APIs, tooling and related intellectual property.
- Feedback may be used by e-tailize without restriction, provided it does not include confidential developer information.
6. Data flows
The MCP may transmit prompts, tool calls, product data, order data, marketplace data, logs, identifiers and technical metadata.
MCP prompts, tool calls and logs are retained for up to 30 days for operations, security and abuse prevention, then deleted or anonymised, unless law or an order form requires otherwise.
7. Pricing
MCP pricing and access tiers are agreed individually. Get in touch with sales@e-tailize.com; the agreed terms are confirmed in a signed order form or developer agreement.
8. Termination
Either party may terminate MCP access according to the order form. e-tailize may suspend access immediately for security, marketplace compliance or material misuse concerns.
9. Liability and law
Liability is capped according to the applicable order form or main Terms. Dutch law applies and Dutch courts have jurisdiction unless mandatory law requires otherwise.
